English
  • ex injuria jus non oritur term
Definition Principle of international law according to which acts contrary to international law cannot become a source of legal rights for a wrongdoer; from the Latin: law does not arise from injustice (or unjust acts cannot create law).
Remark
N.B.:The rival principle is ex factis jus oritur, by which the existence of facts creates law.

Principle was applied in the the US Government's Stimson doctrine, enunciated in a note of 7 January 1932, to Japan and China, stating non-recognition of international territorial changes that were executed by force (i.e, the Japanese conquest of Manchuria then under way). The Stimson here was US Secretary of State Henry Stimson.

Incorrect variant: ex injuris jus non oritur
